Mandatory Electrical Safety Checks

RH & RW Clutton keeps a very close eye on any changes in legislation concerning the rental sector and regularly advises our clients of any changes which may affect them.


There has recently been a focus on legislation concerning electrical checks and the lettings industry has been expecting the Government to introduce mandatory electrical installation checks to the private rented sector.


There is an indication that five yearly mandatory electrical safety checks will soon be introduced with a 6 month window to get to grips with the legislation before it comes into force. The legislation will affect new tenancies or renewals in the first year of implementation before applying to all tenancies in the second year.


Agents and Landlords must ensure that any electrical installation inspectors are correctly qualified to be able to carry out the Electrical Installation Condition Report (EICR) inspection and as a firm we recommend an electric test before a tenancy commences, although this is not currently mandatory.


Properties with a valid EICR will not require a further report until five years from the date of the report is reached.


Whilst the date for the introduction of this new legislation has not yet been confirmed, it is imminent and Landlords and Agents should review their portfolios and current EICRs to ensure that they are prepared for the changes.
