TENANT FEES BAN

The Government’s proposal for a Tenant Fees Ban has been on the cards for some time and, earlier this month, the bill received Royal Assent and has now been passed as the Tenant Fees Act 2019.

 The key features of the bill, which will come into force from 1st June 2019 for new and renewal tenancies, include:

 

 The Act will apply to all existing tenancies from 1st June 2020.

Trading Standards will be enforcing the Tenant Fees Act 2019 with a £5,000 penalty for an initial breach of the ban and will ensure that tenants are able to recover any incorrectly charged fees through a tribunal. Repeat offences could land a £30,000 penalty, as an alternative to prosecution.

 The Government is expected to provide the industry with guidance as to how to effectively implement the ban shortly.

 As with any new legislation it is up for interpretation and changes and it is imperative that Landlords keep in touch with agents who will be able to advise on the correct course of action.
