Electrical Safety Standards Regulations 2020

On 1^st June 2020 the Government released guidance on The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020.

This means that landlords and their managing agents must ensure that electrical installations in rented properties are safe.

A summary of the Regulations:

•  Five-yearly inspection and testing of fixed electrical installations by a qualified electrician.
• Landlords should obtain a copy of the report from the qualified electrician which outlines the results of the inspection and the renewal date of the inspection and test.
• A copy of the report must be provided:
• to an existing tenant within 28 days of the inspection and testing:
• to a new tenant before occupying the premises to which the report relates;
•  within 28 days of a prospective tenant requesting a copy of the report;
•  to the Local Authority within 7 days of receiving a written request.
• If the report requires remedial work or further investigation, landlords must provide written confirmation that the work has been carried out to their tenant and to the Local Authority within 28 days of completing the work.

The Regulations will apply to all new and renewed tenancies from 1^st July 2020, and for all existing tenancies 10 months later, on 1^st April 2021.

The Local Authority will enforce the Regulations and will have the ability to serve a remedial notice should a landlord breach one or more of their duties.  Proven breaches of the Regulations could result in a penalty of up to £30,000.
