RH & RW Clutton defends farmers and owner’s privacy

Instructed by a consortium of concerned owners and farmers at Sharpthorne, near East Grinstead, RH & RW Clutton prepared evidence and arguments to defeat a proposal to re-open a claimed public right of way across private land that would have destroyed the privacy and led to significant concerns about public safety were it approved.
Working with the clients and researching the ancient maps a statement of evidence and law was made and submitted to the County Council.
The County’s legal team have now agreed with our submission and rejected the claimed right of way.
While the claimant has a right of appeal, this is the first major victory in the lost rights of way debate we are aware of, and we are delighted to have been of service to our clients.
