Landlords and Tenants should note that Parliament has now approved the snappily titled “Agricultural Holdings (Requests for Landlord’s Consent or Variation of Terms and the Suitability Test) (England) Regulations 2021”
DEFRA has now widened the opportunities available to farm tenants, enabling them to apply for an arbitration if their landlord refuses consent to changes on their farms that are supported by government incentives.
From 2024, tenants seeking to succeed to a tenancy will no longer have to prove they are not already farming a commercial unit.
Defra is also consulting on giving farmers the right to convert annual farm payments under BPS into a single one off capital payment.
