In a phone call this week a client approached RH & RW Clutton’s Oliver Harwood to discuss the future for the 50 acres they owned.
There is an existing (unwritten) arrangement with a local farmer but the owner was worried about liability for livestock, especially as there is a public footpath across the land and the farmer keeps cattle.
Oliver was delighted to help, explaining the different forms of formal agreement open to choose from, their practical and tax implications (flagging up available reliefs on Income and Inheritance Tax) and the financial outcome to be expected.
The discussion covered the client’s long term objectives, including equestrian enterprises, the need for farm buildings, planning and building regulations and current planning policy.
Oliver will be visiting the property as soon as lockdown permits and will assist the owner with negotiating and putting in place formal documents with the farmer to cover liability and rent, working with the owner to decide a location for a new building and making the necessary planning application.
The client looks forward to seeing him at the property when circumstances allow.
